The patient was identified as a fall risk based upon his medical conditions and the history of a prior fall. The facility created a fall care plan but failed to properly implement the plan, which included a low bed, a floor mat near the bed, and a bed alarm. The resident had two minor falls without significant injuries before he fell while getting out of bed and suffered a fractured hip. He was rushed to the hospital and underwent surgery to repair the hip fracture. He had a long course of therapy and rehabilitation both during and after his hospitalization.
We filed a nursing home negligence lawsuit on his behalf in the Oakland County Circuit Court in Pontiac, Michigan. Depositions of numerous witnesses were taken and then the parties agreed to attend a settlement mediation. After lengthy negotiations, the insurance company for the facility agreed to pay a confidential settlement. The settlement included compensation for the pain and suffering, medical expenses, and other damages relating to the fractured hip suffered in the fall.
